With this privacy notice, we inform you that your personal data (“Personal Data”) will be processed fairly and lawfully, in compliance with EU Regulation No. 2016/679 (“GDPR”) and Legislative Decree 196/03 (“Code”). Data processing will be carried out through electronic and digital means, employing appropriate security measures to preserve integrity and confidentiality.
Pursuant to Articles 13 and 14 of EU Regulation No. 2016/679
Ferrarelle S.p.A. Società Benefit, the Data Controller, informs you that the personal data you provide may be subject to processing operations including collection, recording, organization, storage, processing, deletion, and communication for the purposes described below in compliance with the aforementioned regulations and confidentiality obligations that inspire our activities.
Information and data concerning website users will be processed by Ferrarelle in accordance with Italian law and EU Regulation No. 2016/679.
1. Data Controller and Data Protection Officer
The Data Controller is Ferrarelle S.p.a. Società Benefit, with registered office at V. di Porta Pinciana n° 4, 00187 Rome.
The Data Protection Officer appointed by the Data Controller can be contacted by sending an email to dpo@ferrarelle.it, in order to exercise your rights under the GDPR and Italian law.
2. Personal Data subject to processing
In the case of emails sent to the support mailbox, or completion of the contact form, the data provided are those voluntarily supplied by the user. No data falls within the category of special or judicial data pursuant to Articles 9 and 10 GDPR.
Browsing data may be collected through cookies installed on the site, as reported in the specific section.
3. Purposes of processing and legal basis
For contact purposes, users may complete the contact form or voluntarily send an email to the Data Controller. Any data provided will be used and/or communicated to third parties for the sole purpose of evaluating the establishment of a commercial relationship with the requester. The legal basis is the execution of pre-contractual measures to which the data subject is a party, pursuant to Art. 6, paragraph 1, letter b) GDPR.
Furthermore, even without consent, Ferrarelle may process the Personal Data provided for the following purposes:
i) management and execution of obligations required by law (accounting, administrative, tax, etc.);
ii) management of disputes and possible litigation (as legitimate interest of the Controller);
iii) communications to users who have written to the Controller for commercial opportunities (as legitimate interest of the Controller, subject to the right to object).
4. Storage of personal data
Personal Data will be stored only for the time necessary for the purposes for which they are collected, in compliance with the principles of data minimization and purpose limitation under Art. 5, par. 1, letters c) and e) of the GDPR. Specifically, data related to commercial requests will be stored for the time necessary to respond to the user, and not beyond a maximum period of 5 years.
5. Recipients of personal data
Personal Data may be processed by:
- subjects acting as data processors, pursuant to Art. 28 of the GDPR;
- employees and/or collaborators of Ferrarelle S.p.a., authorized to process data pursuant to Art. 2-quaterdecies of Legislative Decree 196/2003;
- subjects, entities or public authorities, to whom it is mandatory to communicate Personal Data by law or by order of the authorities.
At any time, the data subject may request from the Data Controller and/or the DPO the list of subjects acting as Data Processors pursuant to Art. 28 of the GDPR.
If it is necessary to process data outside the European Union for the exercise of its activities, or to use data processors operating outside the EU, only countries or international organizations for which the European Commission has issued an adequacy decision pursuant to Art. 45 GDPR will be used, or by applying the Standard Contractual Clauses adopted or approved by the European Commission pursuant to Art. 46, c.2, letters c) or d) GDPR, or companies adhering to the EU-U.S. Data Privacy Framework.
Your personal data will not be subject to any fully automated decision-making process, including profiling.
6. Exercise of Rights by the data subject
In relation to the above, we inform you that pursuant to Articles 13, par. 2, and 14, par. 2, of European Regulation No. 2016/679, you have the right to request Ferrarelle S.p.A. access to personal data and rectification or erasure of the same or restriction of processing concerning you or to object to their processing, in addition to the right to data portability; you have the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal; you have the right to confirmation of the existence or not of data concerning you, erasure, anonymization and blocking of data processed unlawfully, updating, rectification or integration of data, obtaining attestation that these operations have been brought to the attention of those to whom the data have been communicated or disseminated. We inform you that it is your right to lodge a complaint with a supervisory authority.
If the data subject wishes to exercise the rights described above and further specified in Articles 15 et seq. of EU Regulation 679/2016, they may contact the Data Protection Officer, specifying which initiative their request refers to.
7. Cookie Policy
Information provided by Ferrarelle S.p.A. Società Benefit pursuant to Articles 13 and 14 of European Regulation No. 2016/679 and in compliance with the requirements of Provision 229/2014 and the “Guidelines on cookies and other tracking tools” of June 10, 2021 of the Data Protection Authority.
What is a cookie
